General terms and conditions of sale

 

1) General information

These General Terms and Conditions of Sale (hereinafter referred to as "the GTCS") exclusively apply to sales made by PAGÈS SAS through its website www.pages.fr.

The purpose of these GTCS is to define the rights and obligations of the parties in connection with these sales. They imply prior and unreserved acceptance.

The GTCS, applicable, are those in force on the day the order is validated.
Indeed, PAGÈS SAS reserves the right to modify at any time some of the terms of its GTCS.
They are accessible on the website and will prevail, if necessary, in the event of a conflict of rules, over any other document.

By accessing the site, you agree to comply with the GTCS.

 

2) Logging into the Website

To order, the Customer must create an account on the Site before placing an order.

When the Customer creates an account, he communicates his first and last name, postal address, telephone number and email address and chooses a password. Its data is then recorded by PAGÈS SAS. His email address will be his login. He can then access his account using his login and password, place orders and consult the history of orders placed. The identifiers that the Customer will have defined during his connection will allow him to recall and modify his data at any time.

The Customer must communicate in an exact and exhaustive way the data necessary for the processing of his order. The protection and confidentiality of Customer data is ensured by PAGÈS SAS in accordance with § 7 of these GTCS and its Privacy Policy.

 

3) Order

The Customer who wishes to purchase one or more Products offered for sale on the Site places an order online for the Product or Products he has selected (hereinafter referred to as the "Order") and for which he will have previously received all the pre-contractual information.

The validation of the Order placed by the Customer on the Site is subject to compliance with the process described below:

  1. Product Selection
    On the Site, the Customer, after having read all the pre-contractual and commercial information, selects the identification and quantity of the Products covered by the Order; these Products are added to his virtual shopping basket (hereinafter the "Basket").

    The Customer can freely modify the Shopping Basket, delete an initially selected Product, modify the quantities ordered or add a Product.


  2. Confirmation of Products and Order Validation

    The Customer who has completed his selection, validates the composition of his Basket.
    The Customer also selects the delivery method before any order is placed and before any payment is made.
    The Customer checks the summary of the Order proposed to him by PAGÈS SAS.


  3. Receipt Confirmation of Order

PAGÈS SAS undertakes to acknowledge receipt of the Order by sending an e-mail to the e-mail address provided by the Customer at the time of the Order or registration on the Site. The Customer checks the completeness and conformity of the information he provides when placing the Order, in particular the delivery address.

PAGÈS SAS cannot be held responsible for any input errors and the consequences resulting from them.

The costs incurred for the reshipment of the Order shall be charged to the Customer.

The Customer is fully aware that PAGÈS SAS can verify and analyse the orders placed.

The confirmation of the Order sent to the Customer by PAGÈS SAS will be archived by PAGÈS SAS and considered as proof of the sale and in particular of its date, price, Products and quantities.

Unless proven otherwise, the data recorded by PAGÈS SAS constitutes proof of all transactions between the Customer and PAGÈS SAS.

4) Prices

On the Site, prices are indicated in euros, all taxes included.

At any time, PAGÈS SAS may update or modify the prices applicable to the products. However, prices are guaranteed as soon as the Customer places the products in his basket. The Customer can only pay by online payment by credit card (Credit Card, MasterCard, Visa, American Express).

The data is entered by the Client on a secure banking platform of the CIC bank using SSL encryption technology, guaranteeing the security and confidentiality of the information during input and during the transaction.

The order is only effective after authorization of the transaction by the bank payment centers and validation of the payment by PAGÈS SAS. To be registered, the order must be paid in full. Orders that have not been paid for cannot be delivered.

The invoice corresponding to the order placed by the Customer is sent to him by email and is also available online on the Customer's account

Default of payment:

PAGÈS SAS reserves the right to refuse to make a delivery or to honour an order from a Buyer with whom a payment dispute is pending.

 

5) Delivery

Orders are processed by PAGÈS SAS's logistics department as soon as possible after confirmation of the Order by the Customer. Delivery times will be 5 to 7 working days.

In the absence of the consignee or a person who may take possession of the products upon delivery, the carrier will leave a delivery notice at the delivery address indicated by the Customer. This notice will indicate a representation the next day or invite him to pick up his products within fifteen (15) days at a specific pickup point. Under no circumstances can PAGÈS SAS be held responsible for any delay in delivery or any deterioration of the products due to their late collection from the carrier.

During periods of high activity (October to March), delivery times for orders may exceptionally be extended.

PAGÈS SAS cannot be held responsible for any delay due to a case of force majeure.

 

5.1) Impossibility of delivery - Cancellation of order

In the event of an incomplete address, incorrect address, refusal of the package by the consignee or lack of information leading to an inability to deliver the product to the consignee on time, PAGÈS SAS cannot be held liable for non-compliance with the contractual delivery date.

 

6) Right of withdrawal

In accordance with Article L. 121-21 et seq. of the Consumer Code, the Purchaser has a withdrawal period of fourteen days from the date of receipt of his order to return the ordered products, without having to justify any reason or pay any penalty.

As part of the exercise of his right of withdrawal, the costs of returning the products are the sole responsibility of the Purchaser.

The Purchaser may make an unambiguous statement and send it by post or electronic means in order to exercise his right of withdrawal.

Subject to compliance with the conditions set out below, PAGÈS SAS will refund the Purchaser the total amount of the returned ordered products, including the delivery costs paid when the order was placed, within fourteen days of the date on which PAGÈS SAS was informed of the Purchaser's decision to withdraw from the contract.

PAGÈS SAS will make this refund using the same payment method as the one used by the Purchaser for the initial transaction.

This right of withdrawal may only be exercised for complete products, returned in their original condition (including original packaging) with a copy of the purchase invoice (received by email when the order was confirmed and available from the customer account on the Site) including the return number assigned by email by our Customer Service and the delivery note (attached to the package upon delivery).

The Purchaser must return the products to PAGÈS SAS at the latest within fourteen days of the communication of its decision to withdraw.

 

7) Data protection guarantee

PAGÈS SAS does not communicate the Customer's personal data to third parties and processes them in strict compliance with applicable laws and its privacy policy.

In accordance with the Data Protection Act of 6 January 1978, the Client has the right to access, rectify and delete personal data concerning him/her by writing to PAGÈS SAS at the address below:
